As the Agricultural Marketing Service continues to execute acquisitions under the Food Purchase and Distribution Program, offerors are reminded to read the solicitation in detail. The solicitation tendering text contains important details specific to each acquisition. Additionally, the Master Solicitation for Commodity Procurement (MSCP) which is incorporated into each trade mitigation solicitation can be found in the AMS Master Solicitation for Commodity Procurements.
In an effort to ensure compliance with the MSCP, offerors should to take note of the following information:
- Paragraph 4A52.209-1 Past Performance with Regard to Offeror’s Present Responsibility
- Paragraph 4A52.214-1 Electronic Submission of Bids
- To submit bids, a company must be approved by the Contracting Officer as meeting vendor qualification requirements. For information regarding how to become a qualified bidder, visit the AMS Selling Food to USDA web page.
- All bids shall be submitted in accordance with Federal Acquisition Regulation Part 14.304. Offerors are highly encouraged to submit offers by 5 p.m. the day prior to the bids due date and time. This approach allows the offeror adequate time to ensure all required offer components are included.
Offerors are subsequently reminded that determinations of offeror responsiveness and responsibility, as it pertains to compliance with all solicitation terms and federal regulations, are the sole responsibility of the contracting officer. Offers that do not adhere to solicitation and regulatory terms will be rejected. Revisions to offers will not be accepted after bid opening.
