USDA Files Action Against Steven P. Heyer, Palmetto, Florida

WASHINGTON, April 20, 2010 – The U.S. Department of Agriculture has filed an administrative action against Steven P. Heyer, a broker operating in Palmetto, Fla. USDA has requested a 90-day suspension of his Perishable Agricultural Commodities Act (PACA) license.

In the action, it is alleged that Steven P. Heyer, while operating as a broker, failed to maintain records and failed to perform the duties of a broker.

Heyer will have an opportunity to request a hearing. Should USDA find that Heyer committed the alleged violations, its PACA license could be suspended and Heyer could not be employed by or affiliated with any PACA licensee during the suspension period.

The PACA establishes a code of good business conduct for the produce industry. Under it, all interstate traders in fresh and frozen fruits and vegetables must be licensed by USDA. USDA is authorized to suspend or revoke a trader’s license for violating the act.
