WASHINGTON, June 3, 2020 – As part of its commitment to ensuring fair and competitive markets for the livestock, meat and poultry industries, on May 27, 2020, the U.S. Department of Agriculture’s (USDA) Agricultural Marketing Service (AMS) reached a consent decision with Mike Perschbacher (Perschbacher), Sulpher, Okla., for an alleged violation of the Packers and Stockyards (P&S) Act.
An investigation by USDA’s AMS resulted in the issuance of an administrative complaint on Nov. 7, 2019, against Perschbacher. The investigation revealed from June 2016 to March 2017, Perschbacher purchased a total of 7,009 head of livestock for $982,448 on a commission basis without obtaining the necessary bond or bond equivalent.
Under the consent decision, Perschbacher was assessed a $4,100 civil penalty and is prohibited from operating as a livestock dealer for seven (7) days and thereafter until he provides AMS with an application for registration and bond coverage.
The P&S Act is a fair-trade practice and payment protection law that promotes fair and competitive marketing environments for the livestock, meat and poultry industries.
